Good Evening lawyer,
My self Seshu had married with a girl on 26th Feb 2020 and after 10 days of together went back to work. During this 10 days i had inter course with her 5 times only. After resume my work had communicated with her over phone and talk to each other. during this conversation her intension out has keep on telling that age between us and about my potentiality. Age between her and me about 14 yrs before agree to marriage spoke to mediator and their parent about the same and said no issues but after marriage was concern for her and expressed the issues of the same to her father to talk with her and understand. Post update on the same her father immediately sent 10 people to my house and argued like 5 times in 2nd time visit took her daughter back to their home and given the time to me to decide about marriage togetherness or dissolution, during the time my father was unwell and treatment was happened at home. one of the day my father expired during this situation and his condition of health. My mother had informed to her parents to send his daughter for my father funeral formalities purpose they did not send. during my father funeral days at 10th day they all come to home around 30+ people and asked about my decision about her said this is not the right time and have so many other things to do due to lost of my father but they did not listen to me and all the people had argued on me and taken in a car to their girl house and tortured, beaten by group of people and taken my cell phone and left me at home after 10hrs and took the Gold ornaments from home.
Based on the my cellphone call recordings, photos, videos and some of my relatives also helped to them and created illegal affair with my long relative sister, they came one day for settlement of 50 lakhs and then 25 lakhs in front of some mediators.. Finally i have sent the lawyer notice to them and no response and after given complaint against them and called police people to them and no response.. They are torturing my mother through a mediator about the money to settle.

Now i want divorce from her as early and kindly give the advise how to approach.

A.Hi,
You can file a case for divorce stating mental cruelty as a ground of divorce under section-13(1)(ia) of the Hindu Marriage Act, 1955.
