We have well in my land we are decide to close the well but some people says we made an agreement with your old land lord before 40ago to take water from this well so we don't allow you to close the well .they had the agreement original copy . is there any way in this case

A.Yes they can enforce the easement agreement, it pertains to use of well water issue, better to consult professional property lawyer from panel of Vidhikarya to protect your interest on all aspects of the issue.

A.Let them go to them. Agreement must be registered. They must prove easymentary right.

A.may be your previous owner had given those right to those people. If so given then it is not possible to close the well.

Sir we already closed the well but they making some problem in it they are saying that we need some settlement for this agreement .on that agreement they paid only 50 rs for this right to fetch water from our well .i need to know if they make any case by this agreement and also if we want to pay something for him.

since there are having a valid agreement, they can enforce the same through Court. Hence you can try to have a negotiation and settlement with the people having right over the well. Please specify the location, state where you property lies. If you are settling with those people please prepare an settlement agreement specifying relinquishment of rights over the well
