A.Hi,

Yes, you can claim for your father's job on compensation grounds. As per the decision of the Supreme Court the appointment on compassionate grounds cannot be rejected merely on the ground that the benefits have already been taken by the family members.
The consideration for such employment is not a vested right which can be exercised at any time in future, so you must exercise this right as quick as you can.

Your dad's death should be either “in harness” (dyeing while on duty) or “in service” (that is even if he is not actively on duty but not retired/dismissed etc.). It should Not be a suicide or a murder.
The objective of the Scheme is to grant appointment on compassionate grounds to a dependent family member of a Government servant who has died while in service or who is retired on medical grounds before attaining the age of 55 years (57 years for erstwhile Group 'D' employees).
