They paid for the property with a fake cheque They paid for the property with a fake cheque

My dad needed some money as an emergency so he tried to sell the property to one of his friend's contact. After all the paperwork was done, my dad immediately went to deposit the cheque which turned out to be fake. the "friend" Printed the fake cheque. it has been 4 years and the case is still pending because the other party has refused to show up in court. Please suggest what we should do because we really need the money due to covid times.

A.Hi,
You can file a complaint with the police for cheating and fraud. An ex-parte order can be passed by the Court declaring the title. If the transaction never happened, then the Court will declare that the property still belongs to you. You can then sell it to a genuine buyer.
