Father is missing for last 34 years. Police gave report that he is missing for last 34 years. On this police report, can a court order of succession certificate be obtaibned from the court of competant jurisdiction ? Or, am I to file primerily a case for declaration of 'civil death' in a civil court and then an application for succession certificate can be filed ? Please give suggestion/opinion.

A.Hi,
Succession certificate is a document issued by a competent court (civil) certifying a rightful person to be the successor of a deceased person. This certificate authorizes successor(s) to realize debts and securities of the deceased person.
You may file a petition in the civil court along with all the valid documents.

A.Hi,
A petition in the prescribed format must be made to the competent Civil Court—within whose jurisdiction the asset of the deceased is situated—by the legal heir claiming the asset. The petition should contain names of all heirs; details about time, date and place of death should be mentioned in the application.
You may file a case with all the relevant documents.

As per your inputs your father’s whereabouts is not available so far, you can file a succession certificate in court with all valid documents
