I am 18 years old and a female. My father is extremely violent by nature, and threatens me with physical violence whenever I refuse to obey him, provided that I have my own perceptions which at times do not match with his own. He has caused me extreme emotional and physical suffering (included kicking, punching, strangling and pulling my hair). He has physically abused me many times in front of my siblings. Only yesterday night he threatened to kill me if I ever disagreed with him or came between his relationship with my mother. I have been accepting this abuse for a long time only because I felt that he was my legal guardian and corporal punishment is legal in India for parents, but now I'm an adult and refuse to accept such treatment. Please help me out.

A.Dear,

As you are a major now, you can take decisions of your life on your own and move out of the house if you wish to. You can also take the help of the police in this regard and file a case of domestic violence against your abusive father. You are entitled to claim maintenance from your father as you are not able to maintain yourself and still dependent on your father. You are also entitled to claim maintenance from the share of your father in the joint family property if any. The personal legal obligation of your father to provide maintenance is continued till you married.

A.Since you are aged 18 years now you can disobey him, or move out of the house. If you are having ancestral property you have a right of maintenance as of now and will be entitled to a share in it also. But taking these legal advice and knowing your legal rights is one thing, but you gave to think after filing a complaint against him, where will you go if you don`t have such property but are financially dependent on him. In such case I think you have to ask someone elder in your family to sort this out.

A.C ur unemployed and he is it father and it's his responsibility to care and meet out ur expenses .u have again remedy to ask expenses court too

What will be the consequences of going to police or filing a case against him? I'm a college student and I'm trying to excel in my field, I'm afraid that he'll take away his financial assistance from me before I get a job.
