I resigned on October 9, 2020 and last working day was November 9, 2020. It has been more than 3 months since my last working day, and I am yet to receive my salary. They have not credited my PF money either. I worked for 10 months. They deducted PF amount from my salary but did not credit it in my PF account. They are neither clearing my salary dues nor crediting PF money so that I can withdraw it. Whenever I message, call, or email, they are either not responding or just saying "you will get it". What can I do? Can I complain to labour department or...? Do I have to hire a lawyer to complain in labour department or I can do it online?

A.Yes, can approach Labour Commissioner of that Jurisdiction and file the Complaint. Approach lawyer for issuing legal notice to the organisation.

A.Hi,
You can file a civil money recovery suit. This will allow you to recover the entire amount you are owed. Serve them with legal notice of them same.
It will be a smoother process if you hire a lawyer, we will be happy to help.

A.Hai,
If the employer denies to pay you your full and final settlement then you can send him a legal notice demanding the said payment and if he still denies then, you can file a recovery suit in the civil court. The legislature has enacted a very beneficial law to protect the employees who are subjected to non-payment of Provident Fund amount. You will get the benefits of the Provident Fund scheme if your wages are subjected to the authorized deductions provided under Section 7(2)(i) of the Payment of Wages Act, 1936.
