My father died intestate in 2020. during his lifetime he purchased several self acquired properties in his name, wifes name in total there are now 5 class 1 heirs remaining - mother and 4 sons .... no daughter
My youngest brother after his death has filed a vexatious title suit claiming a 1 / 5th share in all properties ie self acquired properties purchased by father in his name and in mothers name as if all properties held by mother was benami . My understanding is only fathers property requires a 1/ 5 th partition as property in the name of mother is her absolute property Sec 14 HSA. The title sale deeds in her name with no restrictions - , mutation in her name ( 20 years plus ) and as she has sold properties in the lifetime of the father therefore exhibiting full control of ownership.
Should a WS BE SUBMITTED for dismissal of the plaint of simply request removal of mothers property from the plaintiffs plaint. he has done this to harass other defendants including my mother.

A.Your understanding is correct. Property in name of your mother is counted her property only and it is only father's property which is liable to be divided. If property is benami then it does not confer any right in favour of any legal heir of father. Benami property is illegal and being benami it does not be counted as self acquired property of your father so is not liable to be inherited or be divided rather in case of such property the same vest with govt only.

A.And the suit is sustainable irrespective of what others say. It is a partition suit if interpreted correctly and there must even be a prayer for appointment of court receiver and injunction from creating third party rights against all defendants. Ensure that a reply is filed in the Notice of Motion/IA and seek time for filing WS in the suit.

A.Yes, a detailed and a thorough written statement narrating all the facts will have to filed under any circumstance.

He cannot claim rights in the property of the mother as she is alive. And file a motion/IA under Order VII Rule 11 for rejection of plaint in respect of your mother being a defendant.
