My 39 year old brother died of cardiac arrest and he was employed with TCS in Mumbai.
He was having a bad marriage, harassment by his wife and had filed for a divorce petition which was active while he died.
Due to this circumstances, he had willfully chosen not to update his marital status with the employer to avoid any exploitation by wife through future claims.
Father was the sole nominee for all the benefits- PF, Gratuity, EDLI, Pension and Group Life Insurance.

Since he had stated his marital status to be 'single' during Nominations, TCS has considered all his nominations to be INVALID.
TCS therefore has denied any Life Insurance benefit to the father who was the sole beneficiary nominee.

I sincerely appreciate any guidance by the experts here on each of the benefit components.
I understand that PF, Pension would have the claims by the legal heirs but what about the Group Life Insurance?
Isn't the beneficial nominee (father) the only person who should be receiving it?

A.Nominee can get benefits if there is no other Legal heir. In present case Nominee and the legal heir is the same ie. Father of the deceased. He will get his share with other Legal heirs like wife and kids.

A.Hi,
Yes, your father should be receiving the insurance payout as your brother's nominee. Serve TCS with legal notice to repay the same, mention that your brother was in the process of a divorce which was why he changed his marital status to single.
If they refuse to comply, approach the Insurance Ombudsman, they will assist you in resolving the matter.

A.Hi,
This is an unfortunate situation. We will have to look into the terms of the insurance agreement to see what recourse is available.
Alternatively, you can express your grievances to the Insurance Ombudsman.
