I have taken car on lease from a travel company by paying Rs.400000/-. There is a monthly deduction based on the type of car which will be adjusted against the deposit payment. Initially the agreement was made on July-2019 and I was using thier service until December-2020. During this time, when i requested for a change of car he used to give a new agreement and the last car I have taken from him was on August 2020 and for that he gave an agreement which is not on a stamp paper but with his company seal and signature. According to agreement I can stop the service anytime after 3 months by informing him and he will payback my balance deposit. I gave him notice on 4th Jan 2021 and till date he has not made my final settlement. Also he does not answer my calls or sometimes, keeps it switched off. Due to a leg injury I am bed ridden and cannot move out of my home to goto his office. Sometimes he sends sms or whatsapp messages saying he will settle with a day or two but never happened so far. Is there is any legal action, I can take against him ? Please advice

A.Dear Sir,
You may get issue a legal notice followed by case in consumer forum claiming not only the amount but also compensation for mental torture.

A.Hi,
You can file a claim against the company in consumer Court. File a complaint under Sections 415 and 420 IPC with the police, for fraud and cheating.

A.Hi,
Yes, you can seek a refund and damages by filing a case against the company in consumer Court.
You can also complain to the police about fraud and cheating under Sections 415 and 420 IPC.
