My mother has given an handloan amount to our closest family member, which is documented on plain white paper with his signature, now he is harassing to return back the principal amout what she has given, she is an uneducated.Can I file a case on him, will we be able to get the money back as it written on a white paper with signature.

A.Firstly get the principal amount and thereafter your mother can file case for balance interest potion amount. You have no right to file case. If your mother give attorney for filing the case then you can file the case on behalf of mother.

A.Hi,
You can lodge an F.I.R. if you wish to initiate criminal proceedings against the person from whom you need to recover the money. Money Suit: A money suit is an ordinary civil suit before a Court of competent jurisdiction. Criminal Suit: A criminal suit can be filed under S/406 and Section 420 of Indian Penal Code.
