My Step mother had clamed fake charges on me and my sister as we have injured her.
But all those claims are fake as two of my guest were present at that moment as eye-witness. And she dial 100 and call the police. Her family members came immediately after she called her. A huge scene was created outside my house.
Then she went to nearest police station and their she accepted that she want my property (which was directly transfer to me by my grandfather (No role of my father in property)).
I just want some legal advice which can be a alternative to FIR. I don't want to file any FIR as it would directly affect my career and my sister's too. I don't want my name in bad books until and unless I got settle down.
So being of safe side what legal action should I take so that I'll on safe zone for some time and if she(my step-mother) file any charge or complain their will be already an application from my side already.

A.Hi,
Filing a police complaint is the most effective option, especially when your stepmother has already made such a move. Section 389 IPC makes extortion after filing false cases a punishable offence. You can make an application to the High Court to quash false cases under Section 482 CrPC.
If you are determined not to file a case, you can opt for mediation or arbitration, but this is unlikely to succeed.

A.Hi,
You can try mediation or arbitration to resolve your differences. However, filing a complaint is the best way to go forward, it will not have an negative impact on your or your sister. Section 389 IPC makes extortion after filing false cases a punishable offence. The High Court can quash false cases under Section 482 CrPC.
