I have been through sudden demise of my family member and on the occasion of burial/cremation, one of my relative with whom we are not in good terms for a long time, abused me and my family members.

I got to know that I can sue him for defamation. Can you help me answering few questions below?

1 - How long I can file complaint/case after that incident happened?
2 - What are the legal options available?
3 - Since it was a verbal abuse at graveyard, does such defamation case or police complaint stands especially if I cannot produce any witness/CCTV footage or evidence in it?
4 - If I can file a complaint then what is the procedure to follow?

A.1. Limitation is 1 year.
2. Civil or criminal defamation .
3. Oral evidence is ok but there have to be other witnesses which will be helpful.

A.Hi,
1. Limitation period for filing the complaint is 1 year.
2. Civil suit for defamation or criminal compliant.
3. Oral evidence is enough.

A.Hi,
You need to file compliant within 1 year from the date of occurrence, You can sue him for defamation and claim damages. Oral evidences are sufficient. You can lodge a compliant with the police, or institute a civil suit of defamation.
