There is a property in which My husband and his brother has a equal rights. In ground floor there is
three shops and in 1st floor 2 houses and n 2 nd floor one full house occupied by my husband's brother and they orally agreed that shop rents will be taken over by my husband and 1st floor 2 houses for both of them and 2nd floor for my husband's brother. So my husband has entered into a rental agreement with tenants in which My husband brother has signed in a witness column and from 2015 to till Feb 2021 my husband was getting the rent . My husband passed away on Feb 25 2021. Now to whom the tenant has to pay rent ?? To legal heirs or To my husband brother ???

A.husband brother does not want to give you rent which your husband was getting.
he might have some other motives.
you can go for partition.
else rent have to be distributed to all heirs

A.Hi,
The rent would be passed down to the legal heirs of your husband as per the present arrangement.

A.Now since the verbal arrangement was such that your husband will be taking the rent so now there are two options before you. If you want to continue with the earlier arrangement then the tenant will pay rent to you but if you want anything different then you can either talk to the brother or file a case for partition in which court will do the full partition of the property and you will get whatever the court will grant to you.
