A.you had to go for quashing instead of taking back FIR.
FIR once launched can not be taken back easily because police have to answer in court.

legal remedy depends that what is status of FIR now ?

A.Hi,
Both the parties can file a joint petition under Section 482 CrPC for FIR quashing. Thereafter, the Court will check the facts, circumstances and aspects of the matter and after that court will pass an order for quashing of FIR. If you are victim of any false case then you can also file a complaint for fraud or misrepresentation against your husband, if he did so.

A.Hi,
You guys can enter into a compromise. Both the parties can file a joint petition under Section 482 CrPC for FIR quashing. Thereafter, the Court will scrutinize the facts, circumstances and aspects of the matter before passing an order for quashing of FIR. As agreement is made by you and your husband then it will be easy procedure.

A.You may file for quashing of FIR in the High Court or other way round is you may ask police to file the chargesheet in the lower Court and get the date of the same and get your matter dismissed on the first date itself. If you and your husband are in agreement I believe there should not be any problem or legal hassle.

If you found my advice helpful then please provide review and give me *****. Thank you.
