This is about my friend's father. His father committed suicide because of the harassment by his daughter in law. He left a letter clearly mentioning her name in the suicide note along with all details. Police has not yet arrested the lady even after 2 days and she has now left home with telling anything. Kindly advise what action he can take or he should take . He wants his wife to be punished according to the law.

A.Hello,

It's clear cut case of Section 306 of IPC-(Abatement of Suicide) as you said that a suicide note has been recovered...Strange, if police has not registered an FIR till now.

Tell to your friend that file an written complaint against his wife to the Local Police Station and also sent a copy to area SP/DCP.
After that, if no FIR has been registered then file an application under section 156(3) of CrPC before the court.

Thanks with best regards

A.Hi,
Section 309 of the IPC allows you to file an FIR. Notify the police about the letter, and they will initiate an investigation and most likely, obtain a search warrant to locate the suicide note.

Hello Sir,

I follow your answers and all are legally correct and very helpful to the needy. But Sir, as per act 309 of IPC is for "Whoever Attempt to commit suicide" and Section 306 of IPC is for "Abatement of suicide". May be its typo error.

Regards
