Our neighbour had constructed the boundary wall in the backside of our house. They also built a gate on the wall which opens into our property for their ease. Recently we built the fence wall which touches their boundary wall within our property. They want us to break the fence wall so that it doesnt touch the boundary wall and leave a gap to their boundary wall . They also have trees close to ther boundary wall and all the fruits fall on our roof sheet and cause damage to it. They brought in some party workers to ask us to get it rebuilt. However, we also asked them to cut the trees that spoil the roof sheet and also remove the gate that opens into our backyard as it is a concern of our safety. But they have refused to remove the gate and threaten to go legal to get the fence wall broken. Please suggest what is the legal way to proceed for this. Is it illegal to touch the fence wall to the boundary wall?
Also is it legal to built a gate opening into another person's property?

A.it is not illegal to touch the fence wall to the boundary wall.
it is not legal to built a gate opening into another person's property.

Ask them to dare to touch the fence. then you can file FIR with multiple sections on them.
Also cut yourself all branches which are coming into your property.

A.Hi,
Contact the local lawyer and move forward with an injunction if the neighbors continue to enter your land. Also, request an application from the court authorities for ascertaining boundaries.

A.Hi,
Based on the limited facts, it is recommended that you contact the local court to request an inspection. Trespassing on your property will be considered trespassing, and other issues, such as the distance between the boundary and the fence, can only be determined after reviewing relevant evidence.

A.The answer will depend on many facts like the sketch of the house, the easement right of the neighbour, how both houses and properties are places. Over all both of you have the right to enjoy your properties without any intervention and there is any dispute then then you can go to the court to sort it out.
