Cani I file an FIR against a Private Limited company for non-payment of Invoices?
IF yes under which sections and sub sections it will proceed.
(we sale goods to a party on credit period of 60 days and company keeps delaying payment . Now 6months are completed company still didnt pay debt. now company owners are not picking up calls and they also changes address of the company without letting us know.)we had also paid all gst regarding these sale

A.why they have to inform you before changing address ?

First send legal notice through lawyer.
If then also not paid then can file recovery suit.

A.See filing a criminal case for non payment is not a good idea as that will not help you to get the money but in the worst case the other party MAY get in prison but very rare.

For payment of due amount you will have to file a civil case and recover the money. So, you can start with sending them a legal notice first then followed by a civil suit.

A.you can send legal notice including the invoices client wise to the respective buyer. Complaining in Police station will however disturb your business

A.Hey,
You can file FIR for fraud under 415 of IPC against Directors or owner of the company. This is also breach of contact under Indian Contract Act and to recover your payment you should file a civil suit against the company.

A.Hey,
This termed breach of contract under section 73 of the Indian Contract Act. You can draft a legal notice with help of the lawyer to solve it amicably first but if that isn't answer then you can file civil suit for damages and payment of your product.
