My spouse has worked in corporation bank (which is now union bank of india) from oct 2017 to feb 2020. She has submitted resignation in June 2020, but didn't get relieving letter till now. She wants to rejoin the bank now. She has submitted a letter requesting for rejoining the bank on feb 15 2021, but was rejected citing the reason that resignation process has already started. But she didn't get the relieving letter till now. What can she do to rejoin the bank?

A.Hi,
There are two courses available: first, is that you may send them a legal notice demanding your relieving letter or second, you can file a complaint against the directors of the company for criminal breach of trust u/S 406 IPC. However, if you wish to rejoin the same company then it is better to wait a little more before taking any such drastic step.

A.Hi,
You can serve a legal notice to your employer for the relieving letter and then perhaps try to rejoin the company again. It is better if your try to find a job elsewhere as the situation might turn into a feud where the ball will be in the employer's court.

A.If the relieving letter has not been issued then she still can withdraw her resignation and ask her to meet the superior administration immediately and submit her letter before the junior administration can play any foul game. Before the notice period time is over one can withdraw the resignation at any point of time.
