My Father and his brothers sold our ancestral property in the year 2001 My Father and his brothers sold our ancestral property in the year 2001

My Father and his brothers sold our ancestral property in the year 2001. Sale Deed signed by my father and his brothers and my Grandmother. But in the sale deed my name and my brother name mentioned stated as minors. But actually we are not minors as on 9th July, 2001 registration date. My Date of Birth 5th June 1983 and my brother Date of Birth 10th June 1980. Please let me whether will I and my brother have any rights in this ancestral property. Is the registration is valid or not. Can we sue against this registration. Kindly clarify thank you,

A.Only because property belong to grandfather does not mean that such property was ancestral property in nature. In 2001 the date of majority was 21 years so you were rightly minor. Now more than 20 years have already expired so any legal course like filing of suit for declaration challenging the sale deed etc would be barred by limitation. The period of limitation in such case is three years only.

A.Aap disputed sale deed ko court me challenge kare. Chunki jis time sale deed kiya gya tha ho sakta hai aapke natural guardians banate hue sale deed kiya ho. Nabalik ki property ko sale karne ke liye court ki permission hoti hai. Uska apna procedure hai .sale deed ko challenge kijiye.

A.Hi
In order to dispose ancestral property one need to take permission from his successor in case the successors are major. As in the the year 2001 you have become of 18 years the property was sold without your consent and yours consent was must taken in order to sell the property. Now you could file a suit in the civil court claiming back your share in the property sold, and that property could be reclaimed.

A.hello
Ancestral property cannot be sold without consent of successors in case of major and in case of minor you might need to take permission from court. If property sold without consent can be reclaimed by filling a suit.
