I booked a flat in Aug 2014 and builder agreement got signed in Oct 2015, now the builder is asking money on late payment to Rs 3,50,000. My question is when is to be the builder project started date considered, is it Aug 2014 or Sep 2015. As per agreement possession was to be handed over to me in 36 + 6 months. The project original starting date was May 2014 as per builder registered in Rera website. Now what is the project started date accordingly will be the completion date of builder. Can i claim from the builder about my interest on delayed possession, rent, mental harassment i am going through. Please be noted the extra interest amount the builder is asking is verbally as of now and not giving in mail or in demand letter as he says he sent demand letter for this then i have to pay this and this amount cannot be negotiated further.

A.Hi,
You have two legal recourses against the builder now. You can file a complaint before the civil judge's court for the recovery of money involved in the deal. Or you may approach the consumer forum and complaint in regard to inordinate delay in handing over possession.

A.Hi,
You can opt-out of the whole deal and ask him to return all your deposited money. You may have to serve a legal notice for this and then you may also have to file a suit before the consumer court for deficiency in services by the builder.

A.Dear Sir,
You need not pay any amount to him as project was delayed abnormally.

A.You ask the builder to send him a letter so that you can pay him that amount and once you have the letter then meet up a good consumer layer in your city and file a case against this builder for his wrongdoings and delays. You shall get not only the possession of your flat in time but also compensation for all these sufferings.
