Can i take power of attorney from my father to collect the loans given by my father.
My father was unable to deal with him and He was not giving back money to my father....
If I call to him means... He was shouting like.. He was given promissory Note to my father and He was questioning me that Why I am calling to him..!!

Promissory Note has validity i.e 3 years not completed
My father has no guts to send a legal notice to him but I want to send a legal notice to him...
So shall I take power of attorney from my father about that loan and I want to send a legal notice on my name...

A.Yes you can take the General Power of Attorney from your father,however,the terms and conditions therein must contain not only the purpose of giving such power but about your Authority to represent your father before the Judicial- Quasi Judicial,Administrative,State,Central,Local,Municipal and other Statutory Authorities along with all such terms as is necessary to take appropriate legal steps as is necessary against that person for protecting your father's interest.It is necessary to make that GPA registered with all procedural formalities so that in future that GPA cannot be challenged by that person before any Court of Law.

A.Yes if your father agrees you can do so by drafting the same on a stamp paper of 500 INR which should be purchased in your name and register it if possible, however registration is not compulsory since your matter doesn't involve immovable property therefore if you do not intend to register the same than atleast get it affirmed by a Notary. A.Your father aap ko power attorney kar sakte hai. Jiske aadhar par apne father ke behalf par notice bhi de sakte ho or paisa bhi vashul kar sakte ho.

A.Yes, promissory note if in terms of law is valid. Your father can give you POA to act on his behalf and to collect money.

A.Hi,
You can take the POA in your name to manage the finances and the loans given by your father. You will need to adhere to the rules while issuing POA.
