I married before 12 years, I tolerated domestic violence of my husband and his sisters. But now they crossed limit and trying to beat me. I put a disha case. Now they r in bail buy my husband harassing me daily. Police talking differently. I don't have background strength. I dont want to go back but I could not say that I want divorce but they are acting and promising like gentle people but over phone warning me. How can I get divorce and monthly financial support fir my children future

A.Dear Madam,
there is no way why your husband will be excused from providing any financial support to your children and with relevant efforts you can get maintenance for yourself as well. Till then you can file a domestic violence complaint as well as seek help from a competent women protection cell.

A.Hello
Aap ko ek advocate ki aayaskta hogi. Jise aap ko apni problems batani hogi. Vo aap ko bahut hi achhi tarike se help karenge.
Aap apne husband ke khilaf criminal proceedings me jaa sakte hai.
Aap domestic violence ke liye jaa sakte hai.
Aap apne or apne children ke maintenance ke liye jaa sakte hai.
Aap divorce ke liye bhi jaa sakte hai.
Aap ke pass bahut option hai jinko aap apne husband ke khilaf use kar sakte hai.
But select aap ko karna hai ki aap ko kon sa option lena hai.

A.If the local police is not cooperating with you, then it is necessary to complain by post to the Superintendent of Police against such police inaction as well as for the domestic violence exercised upon you as well as for FIR under section 498A of the Indian Penal Code,1860,as amended up to date.

Please take note that if even after that the Police doesn't start investigation, then you have to lodge complaint before the Magistrate against such Police inaction.

If you don't have background strength then try to approach Women's Commission of your State in this regard who will provide you support not only in this regard but also for claiming maintenance for you as well as for your children. Please take note that you are entitled to lodge separate FIR under Section 406 of IPC if your Husband and in- laws are withholding your Streedhan (jewellery etc)and refuse to hand over the same.
