sir,a person has to give us rs 3,20,000 ..he is just postponing ...he has a land on his name that has a value of 5 lack,so we said to change the documents on our name,and also wrote promissory note ... we have his signed on both promissory note and 100 rs bond papers...but the originals are with him... he still did not give us a rupee...hoew should i further proceed...please help me with this

A.Original PN is with the borrower. If you want to take land then make a sale deed and get it registered in concerned sub registrars office in your favour. Pay him the difference. Write entire consideration in the agreement, already paid amount and balance amount now being paid. PN remaining with the borrower is not of any use to you, nor the bond papers, as far as the land transfer is concerned. Registration of sale deed is necessary to get proper and legal right title and interest to the property.

A.First issue a legal notice asking him to refund the amount at the earliest.

A.It depends upon the facts and circumstances in which you have given him that much of amount. You may send him legal notice asking him to repay your amount. Better to consult in person.

A.You have to approach to court for performance of contract in your favoured or u can file a money Recovery suit againt him
