Hello Sir / Madam, I wish to submit that i have given money amounting to nearly Rs.6 Lakhs on various occassions to my cousin sister during 2013 to 2016. All those were given as Bank NEFT Transfers. I have reminded her lot of times from 2018, but she kept idle in this regard. Now i have no evidences like any Loan Agreement / Pro-Note. I have also not mentioned any interest rate with her, at the time of giving the money. Now i want to know if i could take any legal against her to retrieve my money from her alongwith interest as applicable..

A.Dear Sir,
Normally, money can be recovered and suit can be filed only within 3 years from the date of last transaction. You must make something to continue the cause of action. You must get admissions from the borrower to file a civil suit.

A.Dear concerned,
You need to issue demand notice with all circumstances stances of her demand and payments made by you datewise detail to her . If she avoids then you may process to file criminal case of fraud cheating case at your civil court also civil case of recovery of money. Firstly issue demand notice to her.

A.A considerable time has already lapsed and limitations to file such case is 3 years only. To bring case with limitation few details are required to be examined. You are entitled to interest and court expenses. In such case generally bank rate of interest prevails.

A.in the given facts and circumstances you can file a case for recovery of the amount. It's a benefit for you that you did some transactions through a bank. It will definitely help you in your case and you can succeed in the recovery of money.

A.Hi,
You can issue a legal notice to her for claiming your amount. Since it was a NEFT fund transfer, you can prove your transfer and she can't escape saying the transfer had not taken place.

A.Hi,
You have right to get your amount back from her. Since it was a NEFT fund transfer, you can prove your transfer to her in the court. If you had any losses because of her delay, you can claim compensation too.
