I took the custody of the child 13 years ago. Now after doing DNA I have come to know the child is not mine. I have been cheated from my ex wife for all 13 years. I want to put this child in orphanage. How can I do it.

A.Dear Sir,
We would suggest you to take criminal action against your wife for the offence of cheating, and it is a non bailable offence with imprisonment of more than 7 years. You can also take divorce on the ground of that cheating or fraud she has done with you. You can not put that child into orphanage as it would not be appropriate to keep the child in the orphanage when the biological mother is known to you. About the aspect of child custody, you can surrender her to her biological mother i.e. your wife.
It would be evident to say that if that child is not yours then, you are not entitled to give maintenance until and unless the wife do not file for any maintenance case to claim for child expenses.

It would be suggested to file a criminal complaint against your wife for cheating and you could also make it the basis to get divorce from your wife. Also you would be not liable to pay any maintenance to the child. Instead of giving the child to orphanage give it to your wife and get divorce.

It would be advised to make this a ground for getting a divorce and get seperate from your wife and instead of giving child to orphanage give to your wife and get seperated. Also file a criminal case for mental harrasment, cheating against your wife.
