My husband died and we have no childern. We were supposed to claim his group term insurance I don't who he has kept nominee and his office people doesn't reveal that. My in laws are divorced and never took care of his son. But now his father remember that he is his son and said he has legal rights to claim insurance as I don't have child he gets 50%.we agreed to that as well but my motherinlaw requested her share from what parents gets is 50%. Fatherinlw is not ready to do so he tried to change her name in death certificate to his current wife name. As he sent notice to company saying family certificate made by me has disputes as they are not in that expect me, not to process the insurance. Now what am I supposed to do his company and guy who collects insurance are favor to my father in law they told me to get legal notice through court then only they will process the claim.
It would be suggested to contact senior officers of the insurance company, write them a letter explaining your issue and take action in this regard. Also after your husband death you have right to claim his property.

According to the Hindu Succession Act, which governs Hindu succession and inheritance in India, if a man dies without leaving a will, his property will be divided equally among his widow, children, and mother. since there is a minor child, therefore, the property will be equally divided between the mother and the wife and child.

A.Dear Mam,
As per the Hindu Succession Act, the immediate legal heirs of your husband are you and your mother in law. You can get 1/3rd of the share and the remaining will go to your mother in law i.e. biological mother.
