Can I file civil case in Ghaziabad state court if the family dispute happened in Delhi region. I want to do that as my office is in Ghaziabad. Please let me know.

A.Dear Sir,
It cannot be filed and even if filed it may be transferred to Delhi by the concerned High Court for want of jurisdiction. Normally, the family cases will have to be filed where wife’s resides or in other cases where immovable property situates.

A.Hi client,

No, unfortunately you cannot file a case in Ghaziabad if the cause of action arose in Delhi region.
It lacks jurisdiction. Hence, it is advised that you file the case in the Delhi court as per the jurisdiction.
And, if you have a time management issue, for most of the civil cases you do not need to appear on a regular basis. Your advocate can handle the same. You just need to appear on certain vital dates like admission, hearing etc, which your advocate will explain you further.

A.Hello Sir
You could file the case in the court having the jurisdiction over that place. You cannot file case in Ghaziabad court if cause of action arose solely in Delhi. Therefore it would be advised to file a case in court of Delhi.

A.Hello Sir
No sir it wouldn't be possible to file a suit in Ghaziabad if the dispute happened completely in Delhi Region. It would he advised to initiate the suit in the Delhi Region under the court having its jurisdiction.

A.No, for dispute at Delhi you cannot file case at Ghaziabad court due to lack in jurisdiction if Ghaziabad court. If party of dispute happened in Delhi and part in Ghaziabad then you can file case in either court.

The case can be filed only in that jurisdiction where the subject matter is situated. If the dispute has happened in Delhi, then, you can file the case in Delhi only as the cause of action has arose there.
