File petition to make other party appear in court

We are in settle in process. It has been decided to settle money in front of judge in court. But nonW the other party is not showing interest in settleMent through court, there by he unnecessarily prolong the matter , in order to do the settlement outside court. But we are interested only in settleMent through court. What can be done legally to make him appear in the court , so that we can do the settlement legally at the earliest. Please need your legal advice."

In this case you can file an Interlocutory Application mentioning about these things into it, so that court may take action accordingly.
