can someone put up Borewell outside his house?

A two storey building consists of 8 houses, they put up Borewell outside their building, which is a common path. is it legal? can we remove this borewell or claim for public Use? whom to complain about this?
A.Hi,
It was determined that the side lands were also included in the public road. Trespassing on highways and dedicating a public path are both conceivable. The Indian Penal Code, section 462, was enacted in 1860. If a person is entrusted with property and tries to open that receptacle containing property with the aim to conduct damage or dishonesty, he is responsible under this clause.
