Boundary Wall Dispute Boundary Wall Dispute

Respected Sir/Madam,
I want to take one legal advice from you. Sir, actually there is dispute going on in our area relating boundary wall of our colony. The two brothers have broken the boundary wall of our colony some time ago which separates our colony and their basti (slum area) but around 10% portion of that boundary wall still exists and they are doing illegal construction which's face is towards our colony due to which the residents of our colony are opposing this and we now want to reconstruct our boundary wall in the same place where it was before and that boundary wall was made by the builder and it is also in the map of our colony. Now I want to know that whether we can reconstruct our colony's boundary wall straight away or do we need to take permission of Nagar Nigam before reconstructing our colony's boundary wall.

A.HI,
You have to look into the legal standing of the property at hand and then go ahead with construction. If there are legal encumbrances then the parties may file injunction suits to which you have to represent yourself in the court of law. You can seek to take permission from the Nagar Nigam before construction as they will be in a better position to state the legal standpoint of the property.
Thank you.

A.Hello Sir
It would be suggested to file a complaint against the person doing illegal acquisition of land and destroying the boundary wall in the police station. You all could construct the boundary wall back and you don't need qn permission for the same if the boundary wall has beeen in the approved plan of the builder.
Thanks
