Father own property given to adopt daughter as gift deed (unconditional) registered, but still father is living in that property and also getting rent from that property. Now his relatives manipulates him to sell the property so he filed complaint against his daughter as he got cheated. She filed a suit in court. His complaint gone to RDO enquiry but our advocate told we already filed a case in court. RDO enquiry is completed. Now he is trying to file case under senior citizenship act. we have put caveat and injuction petition in court. Now what will be his next move?

A.Hi,
1) An unconditional gift deed cannot be revoked by the donor. It can only be cancelled by the court in cases where it s found that there was fraud or undue influence.
2) Since he is trying to file a case under the senior citizenship act, you would be issued a summons by the court to appear in front of them. During that time, you can produce all the relevant facts and proof to prove your case that the gift deed was issued in favour of the adopted daughter without any fraud or undue influence.

A.If he is going to file a case under Protection of Senior Citizen Act then you shall receive a court summon to appear in the case and put forward your counter. There you can bring out all the facts in front of the court to get the order in your favour.
