Can I file both Civil & Criminal defamation case at the same time or one after another for the same matter?
What would be the starting point for both the types, means how will the case initiates and progresses?
In case of CIVIL defamation case, if court rejects the case on some ground; would they return the fees submitted (7%)?
If both the cases result on my side, will the accused have to pay the money claimed and also have to serve the punishment?

A.Hi,
Yes, You can file both criminal and civil cases of defamation at the same time. In the civil suit, you are getting compensation for your damages whereas, in the criminal suit, the offender will be punished. You won't get any refund if the case gets rejected.

A.Yes you can file both the cases together as law does not stop a person from getting relief under the civil and criminal adjudication for the same matter. In case your civil case gets dismissed you won't get any refund of court fee. If in both the cases you win then you will get paid and accused will get penalized.
