A.Dear Sir,
If the children are minor and if both parents left behind the children then somebody on behalf of children can file maintenance case and get maintenance from mother and father.

A.Dear Client,
The mother or father of the children whether legitimate or illegitimate is liable to maintain their child who is unable to maintain himself. Every personal law i.e. the law followed by the mother or father made compulsory to take proper care of their children. A general law i.e. Section 125 of Criminal Procedure Court provide that a magistrate can provide for maintenance to child from parent who refuse to maintain the child and interim maintenance can also be given as per the background of the case.
Thank You.
