good morning,

I have a question regarding my housing society. My society is registered as a co-operative society from Ahmedabad. In my society few committee members and chairman are not owners/proprietors in that building, still they are in committee. for eg. My society's current chairman do not own any property in my building. That flat is on his wife's name. So can he become chairman of society as per law? or only his wife can serve as chairman?

A.Dear Sir,
Before answering your questions bye-laws of the Society is to be read. He can become chairman of the Society if rules permits.

A.Dear Client,
In general law, yes he can be the chairman of the society with the permission of his wife. But it also depends on the specific laws of your society and if the society own laws has any law on its contrary then the society law is applicable.

A.Dear Client,
Unless there is an explicit rule in the society bylaws allowing others to represent, a property or flat owner can usually only become an office holder in any society. However, such a rule should not be accepted by all members.

A.Usually a property or flat owner can only become an office holder in any society unless there is written rule as per the society byelaws to allow the others to represent. But in my understanding that kind of rule should not be allowed by all the members.
