Gratuity query

I hav 2 queries - 1) I have completed 4years and 8 years and now resigned. Am I eligible for gratuity? (2) it is charitable Trust hospital. They are not paying gratuity if not completed 5 years, if I m eligible for gratuity and management not paying it, what action I can take?
