Hi,

A very renowned builder had sold all the flats in the society promising parking to everyone. However later they identified that their architects had done some miscalculation and around 110 parking spaces are less. So they unilaterally decided to make 110 stack parking (stack of 2 vehicles) without informing the buyers and now forcing last 220 members who booked the flats with these stack parking.

What right does the buyers have here. Can they ask for a full refund as "stack" parking was never informed to them at time of purchase.

Also what would be process to file complaint against such builders who are negligent and work as it suits them

If they had promised and mentioned in the sale agreement that they will be providing covered/open parking and now they are changing unilaterally then you have a good case to reach out to the consumer forum or RERA tribunal against the builder.
