Do mental torture instances mentioned in divorce petition automatically account for domestic violence or we have to file a separate case for domestic violence? My husband is in USA and he and his family harassed me mentally, for which there are no proofs. He has also taken lot of money from me as he was not spending any money on my expenses. His family in India received the first notice of divorce but refused to receive the second one. What are my options and next steps to get a divorce and my money back and punishment for domestic violence?

A.Dear Client,

Yes you need to file a separate case for domestic violence, as the previous suit dealt with divorce. The court can pass an order in the absence of your in-laws or husband. If it is in your favor you will receive the appropriate remedy.

A.Dear Client
if the family has already received the first notice or summon from the court then what was the need to send second notice.
Anyways, if the case is already filed and notice is received then the court will pass the ex parte order.
For domestic violence case you need to file case separately
