My son got admission for MBBS in 2019 and new NMC rules applicable from their batch. He failed in 1st year and the SAY examination. As per NMC rules 1st MBBS students failed in 1st year and SAY exam, has to sit with the junior batch and attend regular class. by the time SAY exam results published, about 90 % of the classes for junior batch over and he was getting only 30 days to sit with the junior batch before applying for the next exam. since he was too depressed he couldn't attend those 30 days classes with junior batch. now college/university is not allowing him to write the next exam citing shortage of attendance. As you are aware 30 days classes will not bring a fruit as the classes are not covering full portion. is there any chance he can get permitted to write next exam

A.Dear Client
Rule is a rule and once has to follow that in words and spirit. He should not have missed those 30 days classes to become eligible to sit in the exam. You may try to appeal to the college administration to allow him to sit if they agree fine else you can try to reach out to the court but I am afraid that court might not be passing order in your favour
