Could you please provide alternative option to initiate hearing in court for scenario that " wife raise charges against her husband, father/mother/brother in law as domestic violence, charges for dowry etc. Main accused husband ran away and not willing to surrender. As a result, hearing for other accused's case not yet started and are suffering a lot, although they are not guilty/having sufficient proofs also. Please provide references of similar situation case filed in court.

A.Client may opt a move in court concerned for framing or trial in absconding of husband, or for criminal writ or quashing if in-laws has been falsely been involved.

On taking side of Wife, as this you did not make clear of from who's side.Fine anyway, O move petition below court husband should be issued warrant to appear in court, failing which may be argued for declaring absconder and permanent arrest warrant may be issued by court consideration after observing facts and circumstances before the court. A.If this matter is pending you should ask your lawyer to move for passing order for arrest by court. And take accordingly further action through your lawyer.

That is already done and instructions given to both the party as well as police to find him. We are trying to find him and not sure about police as well as opposite party. This thing is continuing from last 4 year and court hearing is not yet started. The issue is not my parent are approx 70 years and I am working in private firm where availing vacation is also not easy. Is there any other alternative/reference which can be used to initiate the hearing for my parents/ for me in absence of main accused. We do have sufficient proofs which shows us not guilty. It will be great help if same can be provided as my parents are aged/ I do have my family as well.

Your old aged parent may be exempted from appearing in court, or get order from High court for same, except you .Contact lawyer near by. What are proofs can be judged from eyes of lawyer's law not what u r saying, may be or not.
