For changing the date of birth in SSLC and service records I filed a case in the Munsif Court in 1994 making the Director School Education (DSE), my employer and my father as parties. Munsif Court ruled in my favour in January 1996 based on the Birth Certificate. After lots of appeals in lower & HC, DSE corrected the SSLC records in Aug 2021. My employer is refusing to change in the service records. I had filed an EP. It was dismissed in lower court on flimsy grounds. I filed a CRP in HC. In Jan 2022, the CRP was dismissed again on flimsy grounds. I'm left with just three months to retire as per service records. I have obtained my birth certificate, passport, PAN, AAdhar card, PRAN, DIN, Voter ID, bank and demat accounts all with the original date of birth.
Since date of birth as per AAdhar and UAN is not matching, EPFO says unless employer agrees, he won't pay me pension. same is the case with post retirement medical insurance for self and spouse. What should I do now?

A.Dear Client,

As per the facts mentioned, you may file a writ of mandamus in the high court praying that to direct the employer to change the DOB in service records.

A.Dear Client
Have you exhausted your option of filing the writ petition in the Hon'ble High Court? If not then take that route and file a writ petition asking the employer to change the date of birth. The High Court should listen to your pleas.
