Adverse possession - attacked by some persons
2 years ago
I have filed a OS in district court in 2001 case is still pending i have a doubt defendants want to claim Adverse possession since 2006 they are in possession up to till date they have completed 12+ years but the OS is Still pending Are they eligible to claim as Adverse position as they are in position when OS is pending?
A.Dear Client,
They should allow the claim for an adverse opinion as the case has already been initiated against them and the matter is in the court and is sub-judiced.
Thank You

A.Dear Client
If the case has already been initiated against them then in my opinion they cannot take the benefit of adverse possession as the matter is in the court and is sub-judiced. The court should allow them to move an application for adverse possession.
