Sub: Rental payment dispute in court.

My father has given house to an tenant on rental basis with verbal terms, which usually happens in rural areas. My father recieves home rent by hand. Consistently tenant was bothering my father regarding rental payment like irregular payment and ignorance towards vacating the property.

One day, tenant has filed a case stating, my father has given house to tenant on rental basis for 6years on verbal terms with rent of 2000rs. Actual amount was 5000rs. Case was filed by tenant 1year ago. Tenant was not attending the hearing and bothering us.

We haven't written any rental agreement to tenant and have no proof regarding rental amount. So, how to collect actual pending rental amount through court and vacate the tenant.

A.Dear Client,
if there is no rental agreement, a tenant can still prove his/her tenancy by showing the rent receipts.Since a rent agreement also states the penalty for delaying.
