I had been working in a private hospital for the last 10 years.Due to twin pregnancy, I was on leave(no pay leave) since July 2021. However, on March 2022 after delivery, I was told that I was terminated as my leave application for 1st - 5th Feb, 2022 was rejected and it is the hospital policy to terminate employee not working for a continous 5 days.I was not informed that my leave was rejected nor I was given any notice for my termination Can I take legal action against my employer

A.Dear Madam,
Yes, you can take strong legal action by issuing the legal notice or approaching office of Labor Commissioner under Section 12 of Industrial Disputes Act as it is illegal termination without following natural principles of law to be followed in Service Law.

A.Dear Client,

As per the facts which have been provided, you can check the details stated in the Employer Agreement regarding termination of employees. And if you feel that you have been terminated illegally then you can file a case against your employer.

Hope this clarifies your query and requirement.

Thank you.
