Non-Payment of Salary - contract agreement signed between me and my employer
2 years ago
I am an individual who is working for a reputed firm for the past 10 months. As per the contract agreement signed between me and my employer, it was decided that my salary would be credited on 15th of every month. However, for the past few months there has been delays in my salary being credited and it was brought to notice by me to the management. Even after repeated reminders they are failing at crediting my salary on time which has caused me severe financial instability which includes mounting up of interest in my personal loans causing bank officials to turn up at my doorstep. I had tendered my resignation from the organization last month which was not accepted promising me in writing for such delays to never happen again in crediting my salary. However, the same has happened once again which has forced me to approach for help from legal advisors for the damages that is being caused by the firm to me, my reputation, and my family both financially and mentally. Kindly Advice.
Get issue a strong legal notice, if no response is received then lodge a complaint with police and also filed a suit for recovery of huge amount including Rs. 200000/- towards mental torcher etc..
Since they are not giving your salary in time then you have all the right to quit the company as per the terms and conditions of the employment and move on. In case they harass you then you can take legal action against them.
As per the facts mentioned, you may take the contract agreement to an advocate who can go through the terms and conditions and default clauses which are binding upon the Employer as well as upon the Employee.
