Inequal Ancestral Property distribution Inequal Ancestral Property distribution

Dear Sir/Madam,I belong to Hindu family. My dad recieved less ancestral property share being the eldest son of the family. He is given 3 acres of farm land whereas his 4 younger brothers enjoy 5 to 7 acres of farm land. Partition deed was executed between him, his brothers and sisters, his health is not good he had to agree whatever came his way to avoid their fights. Although I was above 18 when this deed executed they never took my signature. I feel they took advantage of my dads condition. Also my dad has one elder sister as she is mentally ill they did not share any property to her legal heirs. Property is 30 km away from hosur, tamilnadu. I feel my first cousins should also get their share. What are the chances of win if we file a case?

A.Dear Client,

If the distribution of ancestral property is according to the will then your father cannot do anything and if not then he can challenge it in the court.
You and your cousins will get the share in the property after the death of your respective parents.
You cannot claim it before that.

A.Dear Sir,
Your father has to file partition suit and seek for reopening of earlier partition or claim a share in the property it is not subject to partition or in which property your father did not get any share.
