Paid fine for CRPC 188 but later found a case against my name
1 year ago
Hi
I was fined for not waring mask under section 188, in Oct 2020. Police collected fine and allowed me to go (I lost the receipt afterwards). In 2022, while doing BGC a criminal case was showed against me in e-court records. Catch here is, the location and date on which incident happened was different in e-Court records than the actual. Also, I wasn't aware of any such case since I haven't got any communication about this case. I tried approaching police station mentioned in e-court records and they did mentioned it might be some one different and because of name similarities you were showing in this case. When I approach my employer and explained them they did asked for receipt.
My question is:
1. Is there a way by which I can find duplicate receipt from any government office. I just remember incident took place in Oct 2020 but I don't remember exact date.
2. On the date mentioned in e-court records I was working from home that day. How can I show with evidence that the person reported in this case is different than me?
3. Can my employer withdraw offer since my name is appearing in criminal case under crpc188?
My answers are as follows:
1. Is there a way by which I can find duplicate receipt from any government office. I just remember incident took place in Oct 2020 but I don't remember exact date.
Ans: You can file a RTI Application to get such certified copy or duplicate copy.
2. On the date mentioned in e-court records I was working from home that day. How can I show with evidence that the person reported in this case is different than me?
Ans: You may produce such records before higher Police officers and solve your problem if not then go to High Court.
3. Can my employer withdraw offer since my name is appearing in criminal case under crpc188?
Ans: It is a petty case as such you need not bother.
Here are your answers
1. Getting a duplicate challan in not possible hence you ask the police station to issue a letter stating that your case is resolved and the case mentioned there in e courts is not yours.
2. If you were working from home then show the log records from your laptop/office site etc.
3. They can if they don't get proper answer.
As per the facts mentioned, you should go to an advocate who could give you better advice after getting all the information regarding the situation and help you with the case.
