Sir/Madam what is the meaning of the following status? is it in my favour or against? I am the respondent. It is the 3rd case, Crimnal Misc DV case in Karnataka, my ex wife had filed this case in 2016
& is in Evidence stage of Pw1, only 3 days gap is given with next date on July 2nd, following is the status "Case called out, No representation from petitioner side. Respondent present. Pw 1 called out, absent. hence, cross examination of Pw 1 taken as not offered. Call on for further evidence if any by the petitioner side by" 1st case - Decree was given with permanent alimony of 8 lakhs in MC case in Dec 2020, 2nd case - Monthly Maintenance case was disposed as they did not attend the court even after multiple orders to attend. My lawyer has withdrawn from the case & I told the Judge that no one is with me. Please advise thanks Kiran

A.Dear Sir,

You have to take copy of the order sheet to know exact position. On the above narration displayed i am of the opinion that the side of petitioner closed and her evidence was struck off from the records as she did not offered for cross examination. Ultimately it may be dismissed provided she did not appear on next hearing and file some application for reopening.
