My father has died but he had signed a sales deed with buyer earlier. Now I wanted to know if we ( legal heir /mother has right to cancel this sale with that buyer. This is ancestor property where our uncles live currently and the buyer is not hindu so we are opposing this sell , so we are thinking is there is a way to cancel this seller agreement with that specific buyer. He has given token money and we are ready to return back but he is asking additional money saying some interest as delay in registration and unfortunately; we were not aware of this sale and even my father did not have a copy of agreement he signed with that buyer. so as I said he is asking money stating that its delay you have to give interest n all and it is mentioned in seller agreement ; so is that correct we have pay that additional money as per contract is he aggreged to cancel or we will do execute this as legal heir so some workaround here .we are confused.
If the property is self acquired property then after the death of your father, his legal heir including children or wife can not question the sale deed. However, the contents of the sale deed place important rule and if it is clearly mentioned in the sale deed that you have paid her in cash then there will be no problem.
