Accident witness - me and some group witnessed an accident
1 year ago
In 2016 , me and some group witnessed an accident and we helped the person who got into the accident to the hospital. When the police arrived they asked us. We with humanity helped the person who was aged 90 to get Into the hospital. We told them one car came and dashed him. Police wrote a statement and took our signature and address details. I told them I don't want to be called into court in the case. I just told what happened here. Police confirmed we will not be called into court for this
Now I am getting call from court police and they are asking me to attend the court as witness. Though I haven't received anything as notice letter to attend as witness from court to my address. Should I attend or do I have a chance to deny it
If a witness in a criminal case refuses to testify, he or she could be found in contempt of court. Being in contempt could result in jail time and/or a fine. A victim in a domestic violence or sexual assault case, however, cannot be jailed for refusing to testify. But the victim/witness could still be held in contempt and fined per Code of Civil Procedure 1219.
The two most common situations where a witness is found in contempt are:failing to appear in court after receiving a subpoena, refusing to testify in court. But here in this case as you have not received any such order, its upto you, though testifying would be helpful for the case.
Thank you.
